At TIDI Products, LLC (“TIDI”), we’re serious about the privacy of our customers and trusted partners. The privacy and security of the data you entrust to us is very important. We have developed this Global Privacy Policy and Notice (we refer to it as our “Privacy Policy”) to explain how TIDI and its subsidiaries (collectively, “TIDI,” “we” or “us”) collect use, share, retain, and protect information about you. If you reside in California, please also see our California Consumer Privacy Act Notice. If you are located in the European Economic Area (EEA) or the UK, please also read our Notice under the European Data Protection Laws. If you reside in certain States or you reside in Canada, you may have certain additional rights, so please refer to the What Choices Do I Have? Section, below.
All individuals whose responsibilities include processing personal information on our behalf are expected to protect data by adherence to this Privacy Policy, which is intended to meet requirements globally, including those in North America, South America, Europe, APAC (including Japan and Singapore), and other jurisdictions.
User Consent: Please take the time to review this Policy carefully before you access this website or our other websites or use any of our other Services. By accessing or using our online Services, such as our websites, or by communicating with us via email, telephone, in person, or electronically, including through our websites, you are agreeing to the collection, use, disclosure, and other handling of your information as described in the Privacy Policy effective on that date. If you are under the age of 18 or you do not consent to the collection, use and/or disclosure of your personal information as set forth in this Privacy Policy, please exit and do not use our Services.
We may update this Privacy Policy from time to time and encourage you to review it whenever you interact with us and our Services.
WHAT’S COVERED IN THIS PRIVACY POLICY?
Unless we tell you otherwise, this Privacy Policy applies whenever you access any of our services, including the webpages, communications, and applications where this Privacy Policy is posted. It also applies when we correspond by email or other electronic messages with you, when you interact with us or our advertisements through third-party services, and when we communicate offline, such as on the telephone, in writing, or in-person.
We follow this Privacy Policy in accordance with the applicable laws of the places where we operate. In some cases, we may provide additional data privacy notices specific to certain products, practices, or regions. Those terms are to be read in conjunction with this Privacy Policy.
This Policy doesn’t apply to information that is collected or used by other companies or third parties. They have their own privacy policies that you should read to learn about how your information will be treated. For example, sometimes we link or provide access to sites or services run by other companies. Those sites and services aren’t covered by this Privacy Policy, and we aren’t responsible for the other companies’ practices. You should also keep in mind that when you communicate with us through a third-party (e.g., Facebook, Instagram or LinkedIn), that third-party might also collect your information. Our Privacy Policy covers the information we collect, and the third-party’s privacy policy will cover the information it collects, even if we and the third-party collect identical information.
This Policy does not apply to any personal information that is publicly available.
WHAT PERSONAL INFORMATION DOES TIDI COLLECT?
For purposes of this Privacy Policy, unless noted otherwise, when we use the term “personal information,” we mean information that identifies, relates to, describes, references, is reasonably capable of being associated with or could reasonably be linked, directly or indirectly, with a particular person or household. We may collect the following categories of personal information:
- Contact Information and Identifiers: First and last name, street address, unique personal identifier, online identifier, internet protocol address (“IP Address”), email address, or telephone numbers. We may also collect RN numbers for our clinical education program. We may collect your password if you set up a new user in our E-status portal.
- Financial Information: Credit and debit card information when you place an order by phone.
- Commercial Information: Information about the products or services purchased and purchasing history.
- Internet Activity: Internet or other electronic network activity information, such as browsing and search history, device ID number, your Internet service provider (ISP), approximate geographic location, your web browser type, and the length of time you spend interacting with our Services.
- Employment Information: Professional or employment-related information, including current job title and/or current job location (facility name), contained in resumes or other documents submitted in connection with a job application or when you seek employment with us.
HOW DOES TIDI COLLECT INFORMATION ABOUT ME?
We may collect personal information from the following sources:
- Directly From You. We collect personal information that you provide directly to us when you sign up for a clinical education class, create an on-line account, including setting up an account in our E-status portal, communicate with us, apply for a job, request a catalog or other information, purchase products from us, or complete our forms.
- Automatically. If you complete one of our forms requesting a product sample or to have a representative contact you, we may automatically collect certain personal information from you. If you do not complete a form or log into the status portal, we may still automatically collect certain information about your location and your actions on our pages, such as the number of times you viewed a page and what you viewed. These behavioral data points are kept in an aggregated and/or deidentified manner.
- Third-Party Sources. We obtain data from other companies and public sources. We may combine that data with personal information or other information we collect. We use this to maintain accurate data, improve our ability to contact you and enhance our marketing efforts.
- Online Tracking Technologies. Our trusted, third-party service providers (such as analytics providers and social media platforms and networks) may use cookies, pixels, web beacons, and other similar online tracking technologies (collectively, “online tracking technologies”) to gather information when you interact with our Site. Some online tracking technologies help us maintain the security of our Site, prevent crashes, fix bugs, save your preferences, and assist with basic site functions. We may also use certain tracking technologies to track usage of our Services, including to understand what pages you visited and when you are interested in additional product information.
- Location Information. We may collect approximate geographic location information, such as a city and state associated with your use of our Services. You may choose to allow us to further access your location by granting permission when prompted, or through your device’s location services settings. We also use the Google Maps API(s). Please see Google’s Privacy Policy found here to learn about Google’s personal information collection and use practices.
- Analytics. On our Services, we use analytics tools (e.g., Google Analytics) to collect and process data about your use of the Services, including when you visit our websites, information regarding the websites that you visited prior to visiting our websites, and IP addresses assigned to the devices from which you access the Internet. Our analytics providers may set and read cookies to collect this data and your web browser will automatically send data collected by those cookies to our analytics providers. Our analytics providers use this data to provide us with reports that we will use to improve our Services structure and content. HOW DOES TIDI USE INFORMATION ABOUT ME
We may collect, use and/or share your personal information for one or more of the legitimate business purposes described in this Privacy Policy.
- Communications. To provide you with information that you request or that may be of interest to you; to notify you of changes to the Services (e.g., changes to our Terms of Use or this Privacy Policy) and to provide you with promotional materials and other communications.
- Administration. To manage your account, facilitate purchases, administer our business activities, process your orders, provide customer service and support, monitor and help prevent fraud, investigate complaints and violations of our policies and consider and respond to job applications.
- Website Management. To administer the websites and its servers, generate statistical information, monitor and analyze traffic and usage patterns, improve the our content and the products, services and materials that we describe or make available through our Services, to enhance your user experience, to troubleshoot problems and to improve the functionality of the Services.
- Evaluation and Improvement of Our Products and Services. To improve the types of products and services we offer and how we provide them to you, to inform our marketing and communications efforts and to understand product user demographics.
- Careers. We collect personal information when you apply for a job. If you apply for a job via our Services, you may be required to create an account. If you send us your job application, we will only use and share that job application to evaluate your qualifications to work with TIDI and its related companies.
- Marketing. We may use certain personal information, only after you affirmatively provide it to us via submissions via our Services, to send you promotions or to tell you about our products or services.
- Legal Reasons, Security and Protection of Rights. We may use personal information to: (i) respond to subpoenas, court orders or other valid law enforcement requests; (ii) to protect our legal rights or interests, or those of other persons, (iii) to bring a legal action against you or anyone who may be causing harm to us, our Services, or to other users of the Services; (iv) to seek business, financial or legal advice, (v) to enforce violations of our Terms of Use or (vi) as otherwise required or permitted by law.
We are active on social media, including LinkedIn (“Social Media”). Anything you post on Social Media is public information. We may post (or re-post) on the Services and our Social Media pages any comments or content that you post on our Social Media pages.
Your use of Social Media is governed by the privacy policies and terms of the providers that own and operate those platforms and not by this Policy. We encourage you to review those policies and terms.
DOES TIDI SHARE THE INFORMATION IT RECEIVES ABOUT ME?
We do not believe that we “sell” your personal information as such is defined by applicable privacy laws, and, accordingly, we do not offer a “do not sell” opt-out. We will not sell personal information that we collected without giving you an express opportunity to opt-out and unless we first give you notice of our intent to sell.
We may share or disclose your personal information: (i) with your consent or if you direct us to share personal information; (ii) if you are an EU resident or resident of certain states, to comply with your requests under applicable law; (iii) as disclosures amongst the entities that constitute TIDI as defined above, or as part of a merger or asset sale; and (iv) as otherwise required or permitted by applicable law.
We may also share your personal information with third-party service providers with whom we have entered into contracts that require personal information be kept confidential and prohibit the retention, use, or disclosure of personal information for any purpose other than the services specified.
We may share or disclose personal information as described, for our legitimate business purposes, described below:
- Within TIDI: We may share personal information internally within TIDI, including with our subsidiaries and affiliates and amongst our employees. Our personnel may have access to personal information as needed to provide and operate the Services in the normal course of business and to fulfill our contractual obligations and service commitment to you. We may share personal information with our employees and our subsidiary companies that have a need to know the information for our business purposes.
- Third-Party Service Providers: We employ other companies and individuals to perform functions on our behalf, such as providing cloud-based CRM software to support customer account maintenance and billing, utilizing cloud-based marketing software to provide management of prospective customer information, operating, supporting, improving and securing our Services, providing cloud storage, shipping catalogs or products, providing email services and data processing services and providing data analytics functionality. They have access to information needed to perform their functions but not for other purposes.
- Business Transfers: If we purchase other businesses or their assets, sell our business assets, or are involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information, including any category of personal data we have collected, may be among assets sold or transferred and may be subsequently used by a third-party.
- Lawful Requests and Safety: We release personal information when we believe it is appropriate to comply with the law, it is necessary to protect our interests, to prevent fraud or other illegal activity, and to protect the safety of any person. Nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your information.
HOW DOES TIDI SECURE INFORMATION ABOUT ME?
We realize that you trust us to protect your personal information. We take that trust seriously.
We generally retain the information we collect only for as long as necessary to fulfill the purposes for which it was collected, to fulfill our contractual and legal obligations, or as otherwise required by law. When you make a purchase, we may either retain your information and content for a commercially reasonable time for backup, archival and audit purposes, or we may delete your personal information from our systems as part of a data retention plan and cyber-hygiene policies. We will also delete your personal data when it is no longer needed for any of the purposes described above.
We maintain physical, electronic and procedural safeguards that are consistent with industry standards to help protect the privacy, accuracy, and reliability of personal information and to protect it from loss, misuse, unauthorized access, disclosure, acquisition, exfiltration, alteration and destruction.
We also take commercially reasonable steps to ensure that our third-party service providers reasonably protect and secure your information. If we become aware that a third-party service provider is using or disclosing information improperly, we will take necessary and immediate steps to end or correct such improper use or disclosure.
While we attempt to protect the information in our possession and account for the protection of information provided to our third-party service providers through us, no security system is perfect, and we cannot promise that information about you will remain secure in all circumstances. Please do your part to help us keep your information secure. You are responsible for maintaining the confidentiality of your password(s) and your Account(s), and for all activities that occur under your password or Account(s). TIDI specifically reserves the right to terminate your access to your Account(s) and any contract you have with TIDI related to the use of the Services in the event it learns or suspects you have disclosed your Account or password information to an unauthorized third party.

THIRD-PARTY WEBSITES
Our Services may link to, or be linked to, websites not owned or controlled by us. We are not responsible for third parties’ privacy policies or practices. This Policy does not apply to any third-party websites or to any data that you provide to third parties. You should read the privacy policy for each website that you visit.
WHAT CHOICES DO I HAVE?
TIDI seeks to ensure all individuals are provided with the rights mandated by their governing jurisdiction. Not all of the rights discussed herein will apply to everyone and, depending upon where you are located, you may have choices about the personal information you disclose to us. For example, the CCPA, as amended by the CPRA, provides California Residents the right, under certain circumstances, to request that we disclose, delete or correct their personal information.
If you are a resident of Colorado, Connecticut, Montana, Oregon, Texas, Utah or Virginia, or you reside in Canada, you may have the right to request that we:
- Provide you access to recorded personal information that you have previously provided to us;
- Correct or amend inaccurate information we have about you;
- Delete the collected information assuming that request does not conflict with our legal obligations or other legitimate business purposes for maintaining information;
- Honor your request to opt-out of processing of personal data for purposes of targeted advertising, sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer.

ADDITIONAL DISCLOSURES AND RIGHTS FOR CALIFORNIA RESIDENTS
The California Consumer Privacy Act (the “CCPA”) and as amended by the California Privacy Rights Act (the “CPRA”), also known as Proposition 24, provides individual California Residents (as defined in the Act), specific rights regarding their personal information.
For purposes of the CCPA, personal information does not include: publicly available information from government records; de-identified or aggregated consumer information; and, information excluded from the CCPA’s scope, including: health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data, certain information covered by sector-specific privacy laws, such as the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Billey Act (GLBA), the California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994 (DPPA). Any terms defined in the CCPA have the same meaning when used in this Privacy Policy.
The rights conferred by the CCPA and CPRA apply solely to visitors, users, and others who reside in the State of California. The following sections supplement the information contained in the non-region specific sections of our Privacy Policy, and provide you with additional information, describe your rights, and explain how to exercise those rights.
Personal Information We Collect from California Consumers. The CCPA gives California residents the right to know the categories of information that we have collected about consumers over the past twelve months, the sources of that information, and how (or if) that information is disclosed. Please refer to the “What Personal Information Does TIDI Collect” Section in this Privacy Policy for details about the types of personal information we collect. We describe our sources of personal information in the “How Does TIDI Collect Information About Me” section of this Policy. For a description of our purposes for collecting personal information, and how it might be disclosed, please review the “How Does TIDI Use Information About Me” and “Does TIDI Share The Information It Receives About Me? ” sections of our Privacy Policy, which are above.
- Right to Know, Right to Request Access, and Data Portability Rights. The CCPA grants California Residents the right to ask us about our collection and use of the personal information we have collected, used, and disclosed over the past twelve (12) months. Instructions on how a California Resident can submit a verifiable consumer request for access to this information (referred to as a “Request to Know”) are below. Once we receive and confirm that you have made a verifiable consumer Request to Know, we will make an individualized disclosure to you about:
• Categories of personal information we collected about you;
• Categories of sources for the personal information we collected about you;
• Our business or commercial purpose for collecting the personal information;
• Categories of third parties with whom we share that personal information;
• Certain, specific pieces of personal information we collected about you (“Data Portability Request”); or,
• If we disclosed your personal information for a business purpose, the personal information categories that each category of recipient obtained.
- Right to Request Deletion. California Residents have the right to request that we delete the personal information that we have collected and retained (“Requests to Delete”). Upon our receipt of a verifiable request to delete personal information (see below), we shall delete the personal information from our records and will direct our third-party service providers to delete your personal information from their records. However, please note that we may deny your request to delete and need not comply with such a request (and need not ask third-party service providers to comply) if retaining the information is necessary to perform certain functions or commitments, including: completing the transaction for which the personal information was collected; providing a service requested; otherwise performing our contract with you or taking reasonably anticipated actions within the context of our ongoing business relationship with you; detecting security incidents and protecting against malicious, deceptive or otherwise illegal activity or to prosecute those responsible for those activities; complying with a legal obligation or otherwise using the personal information, internally, in a lawful manner; complying with the California Electronic Communications Privacy Act; fulfilling the terms of a written warranty or product recall conducted in accordance with federal law; or, for a purpose otherwise contemplated by Cal. Civ. Code Section 1798.105(c)-(d) or as otherwise amended.
- Right to Correct Inaccurate Personal Information. The CPRA provides an additional right for California Residents to request that we correct inaccurate personal information that we maintain about them (the “Right to Correct”). We will use commercially reasonable efforts in order to comply with California consumer requests to correct.
- Right to Opt-out of the Sale of Your Personal Information. You have the right to opt out of the Sale of your Personal Information. HOWEVER, IN THE LAST 12 MONTHS, WE HAVE NOT SOLD, AND WE CURRENTLY DO NOT SELL, YOUR PERSONAL INFORMATION WITHIN THE MEANING OF THE CCPA.
- Non-Discrimination. California residents have the right not to receive discriminatory treatment for exercising any of their rights under the CCPA. We will not discriminate against you for exercising any of the rights conferred by California statute, including the CCPA. Unless permitted by law, we will not: deny you goods or services; charge you different prices or rates; provide you a different level or quality of goods or services; or suggest that you may receive a different price or rate or a different level or quality of goods or services. We may offer certain financial incentives permitted by the CCPA that can result in different prices, rates or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects.
How to Exercise Your CALIFORNIA PRIVACY Rights.
You may make a verifiable request to exercise your right to access or data portability twice within a 12-month period. To exercise the access, data portability, deletion, and correction rights described above, please submit a verifiable consumer request to us by either:

Verifying Your Request. In order to verify your request, you must provide sufficient information to allow us to verify you are the individual about whom we collected Personal Information.
We will only use Personal Information we collect during the verification process for that purpose. If we are unable to verify your identity as required under the CCPA, we will decline to comply with your request, and let you know why.
When We Will Respond. We will acknowledge your request or your exercise of the foregoing Rights within ten (10) days of receipt with information regarding how we will process your request. We will endeavor to respond to a verifiable consumer request within forty-five (45) days of receipt. If we require more time to provide a response, we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option.
Who May Exercise Your Rights? Only you or a person registered with the California Secretary of State that you authorize to act on your behalf may make a verifiable consumer request related to the personal information about you. If the request is made through an agent, we reserve the right to require a signed authorization or verification of the agent’s identify from you in order protect the privacy of the personal information requested. You may also make a verifiable consumer request on behalf of your minor child.
We cannot provide you with the information sought in a Request to Know, or comply with a Request to Delete or Correct, if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. A verifiable request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative;
- Describe your request with sufficient detail that allows us to properly understand, evaluate and respond to it.
We reserve the right to require additional information from you to verify your request before we respond. Any information provided to us in a verifiable customer request will be used only to verify the requestor’s identity or authority to make the request.
California ‘Shine the Light’ Law. Pursuant to California Civil Code Section 1798.83, if you are a California resident, you have the right to obtain: (a) a list of all third parties to whom we may have disclosed your Personal Information within the past year for direct marketing purposes, and (b) a description of the categories of Personal Information disclosed, by contacting us per the “Contact Us” Section below.
INTERNATIONAL DATA TRANSFERS
TIDI does not target customers outside of the United States. However, if you are located outside the United States, the information TIDI gathers about you may be transferred, processed, maintained, and accessed outside of your home jurisdiction or in a jurisdiction with different, and less protective, privacy laws. If you are in the EEA or other region with laws that may differ from the United States and choose to allow us to collect information about you, note that TIDI (and/or our service providers) may transfer, process, and store that information in the United States and/or Canada.
NOTICE TO EU AND UK RESIDENTS
The purpose of this section is to provide information and additional provisions that apply regarding TIDI’s processing of personal data of persons located in the EU or UK in accordance with the EU General Data Protection Regulation 2016/679 (“GDPR”) and UK GDPR (collectively, “European Data Protection Laws”). THIS SECTION ONLY APPLIES TO YOU IF YOU ARE LOCATED IN THE EU OR UK.
In the event of a conflict between this section and the remainder of the Policy, this section shall control for those persons located in the EU or UK.
The terms “personal data”, “processing” and “automated decision” have the same meanings set forth under European Data Protection Laws.
- Processing of personal data. Personal Information, as defined above, is considered personal data under European Data Protection Laws. Furthermore, if any non-personal personal information also qualifies as personal data under European Data Protection Laws, then it shall be considered and treated as personal data for those persons located in the EU or UK.
- Legal basis for processing. When TIDI processes your personal data, it has a legal basis for doing so as required under European Data Protection Laws. TIDI will only process your personal data in the following circumstances: (i) it has received your express opt-in consent for such processing, (ii) the processing is necessary for performance of a contract, (iii) the processing is necessary for a legal obligation to which TIDI is subject, (iv) the processing is necessary to protect the vital interests of the data subject, (v) the processing is necessary for a task carried out in the public interest, or (vi) if TIDI or a third party has a legitimate interest that is not overridden by the interests or fundamental rights and freedoms of the data subject.
- Right to Withdraw Consent. In the event you provide your consent for us to process your personal data, you may withdraw your consent at any time by emailing privacy@tidiproducts.com to request such change at no additional cost.
- Marketing. TIDI does not process personal data for the purpose of marketing without first obtaining your express, opt-in consent or having a legitimate interest for doing so. YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF PERSONAL DATA FOR MARKETING PURPOSES AT ANY TIME BY CONTACTING US AT privacy@tidiproducts.com .
- Automated Decision Making. TIDI does not make any automated decisions on your behalf or about you without first obtaining your express, opt-in consent. IN THE EVENT WE SECURE YOUR CONSENT TO DO SO, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF PERSONAL DATA VIA AUTOMATED DECISION MAKING AT ANY TIME BY CONTACTING US AT privacy@tidiproducts.com.
- Data Collected Not From the Data Subject. We sometimes collects personal data from third-party sources and not the data subject themselves. For example, we receive personal data about third parties when job applicants provide references. We only use employment reference information for the purpose of employment verification.
- Your Rights and Choices. European Data Protection Laws provide certain rights to individuals in relation to their personal data with certain exceptions. We will comply with any requests made relating to the following rights if required by applicable law. We may require you to verify your identity before we modify, provide, delete or transfer your personal data.
- Right of Access - You have the right to be informed of and request access to the personal data we process about you. This allows you to receive a copy of the personal data we hold about you.
- Right to Rectification - You have the right to request that we amend or update inaccurate or incomplete personal data.
- Right to Erasure (Deletion) - Under certain circumstances, you have the right to request deletion of your personal data.
- Right to Restrict - Under certain circumstances, you have the right to request that we temporarily or permanently stop processing all or some of your personal data.
- Right to Object - Under certain circumstances, you have the right to object to TIDI’s processing of personal data, such as for direct marketing purposes or when automated decision making is used.
- Right to Data Portability - You have the right to request a copy of your personal data in electronic format and further request that we send such personal data to another party.
- Communication Preferences and Opt-Outs - You have the right to stop receiving communications from us at any time by contacting privacy@tidiproducts.com, at no additional cost.
- Right to Lodge a Complaint - You have the right to lodge a complaint with the applicable supervisory authority. Although you are not legally required to do so, we ask that you first contact us so we can make reasonable efforts to address your complaint.
If you have any questions about your privacy, your rights and choices, or how to exercise them, please contact us with your request at privacy@tidiproducts.com. We will respond to your request within a reasonable period of time.
- Providing Personal Data due to a Contractual Requirement. In certain circumstances, you must provide personal data necessary to enter into certain agreements with TIDI, such as in certain employment circumstances.
- The Consequences of not Providing Personal Data. TIDI will not be able to provide certain services to you without processing certain personal data such as processing job applications. Furthermore, if you turn off certain tracking devices or decline certain cookies on the Services, certain features of the Services may not work.
- Data Retention. TIDI will only keep your personal data for so long as it has a reasonable business purpose for doing so.
